Who You Are

We’re looking for an experienced, creative Associate General Counsel with an employment law and employee benefits background to join a small but mighty Legal team in a remote role with occasional travel to Sunrise, Florida (outside Ft. Lauderdale). The person in this role will help plan, develop, and execute the Legal Department’s strategic initiatives, provide legal advice and counsel on a wide range of employment-law/HR-related and employee benefits-related matters, understand how to operationalize legal guidance, and effectively distill complex legal concepts into understandable terms. This person can expect to assume responsibility and ownership of initiatives from Day One and interface frequently with key stakeholders. The person assuming this role must have mastered an Executive Presence and have a “can-do”, collaborative attitude.

What You’ll Be Doing

Day-to-Day:

Provide practical, day-to-day legal guidance to internal teams on complex topics that may have been escalated in the employee benefits and HR/employment law spaces, such as compliance concerns relating to 408(b)(2) disclosures, Form 5500 requirements, Non-Discrimination Testing, ACA reporting, PCORI, and CMS/Medicare Part D, as well as leave laws, wage and hour issues, discrimination/harassment and new HR-related Executive Orders.

Strategic Business Partner:

  • Work hand-in-hand with the General Counsel, Corporate Counsel, HR, Client Services, and other internal teams to ensure legal strategy aligns with business goals.
  • Partner with the Corporate Counsel to develop trainings or resources on current regulatory issues in an engaging, concise manner.
  • Maintain the perspective of Company strategic goals.
  • Develop relationships with key stakeholders to accelerate understanding of the business and facilitate role success.
  • Demonstrate an Executive Presence during presentations and communications to the Company.

Employee Benefits and Employment Law:

  • Serve as the owner/leader of company benefits compliance guidance, including:
  • Understanding state and federal statutes and regulations applicable to group health plans and retirement plans.
  • Partnering with the Company’s affiliated insurance agency to ensure operational compliance best practices.
  • Conducting periodic operational compliance reviews concerning ERISA, Mental Health Parity and Action Equity Act
  • Affordable Care Act, and other federal health laws.
  • Consulting and advising on plan qualification and fiduciary responsibility issues.
  • Assist internal business units with interpreting and applying legal developments on all aspects of the Internal Revenue Code, ERISA, and other relevant laws as they affect employee benefits plans and fiduciaries of benefit plans.
  • Consult and advise on plan qualification and fiduciary responsibility issues.
  • Provide compliance support for annual tax filings, required plan testing, operational reviews, and corrections.
  • Draft and review client and participant explanatory material (e.g., summary plan descriptions, announcement letters, summary of material modifications, plan documents, summaries of benefits and coverage, etc.).
  • Develop and implement strategic and compliance initiatives across the organization.
  • Manage 401(k), including communicating with recordkeeper for worksite employees and broker. Operationalize issues relating to 401(k) management and handle escalated issues, review Plan documents and RFPs.
  • Manage 401(k) issues, including communicating with 401(k) recordkeeper and broker, operationalizing 401(k) issues and changes, and reviewing Plan documents and RFPs.
  • Proactively support the Company in all areas of employment law matters, including various workplace issues, disciplinary actions, policies and procedures, pay equity issues, and internal investigations.

Management: 

  • Manage employees including the Employee Benefits Specialist and 401(k) Plan Administrator
  • Perform administrative duties and other duties as assigned.

Contracts Management:

  • Review complex client service agreements and vendor contracts.

Staying on Top of Trends:

  • Proactively monitor changes in employment law, tax compliance, and employee benefits compliance.

  • Reports to the General Counsel.

What You Bring to the Table

  • Legal Expertise: You have a background (7-9 years) with a combination of experience in employee benefits, employment law, and compliance.
  • Business Savvy: You see the bigger picture and use your legal knowledge to drive business decisions and strategies forward.
  • Managerial Experience: You have proven experience in leading teams, overseeing daily operations, driving performance outcomes, and supporting the professional growth and development of team members.
  • Proactive Thinking: You’re not just reactive to legal challenges – you anticipate them and come up with creative solutions before problems arise. You own and drive initiatives home.
  • Communication Skills: You’re able to distill complex legal topics into easily digestible terms for non-legal folks. You can explain consequences in a way that resonates with your audience.
  • Adaptability: The HCM/PEO world is fast-paced and changes quickly. You understand that and stay cool under pressure. You enjoy keeping up with changing laws and emerging trends.

Educational Requirements and Licensing Requirements

  • Juris Doctor (J.D.) from an ABA-accredited law school.
  • Member in good standing with the Florida Bar or Florida Authorized House Counsel.

  • Base salary of $160,000 - $180,000.
  • Hybrid (2-3 days in office) or Remote Eligible with a preference for someone in the Sunrise/Ft. Lauderdale, Florida area. If remote, occasional travel to the Sunrise Office is required.
